This End-User License Agreement ("EULA") is a legal agreement between you and Wyrnet Inc ( company ) for the eTikr 1.0 software ( software ) that accompanies this EULA; you agree to be bound by the terms of this EULA by installing, copying, or using the software. If you do not agree with this EULA, do not install, copy, or use the software.

 
  1. Software is free for your personal use pursuant to this EULA and the terms and conditions set out below

  2. You may make any number of backup copies of the software on any number of computers, you may also freely distribute completely unmodified copies of software as you wish, but any commercial use or distribution of this software is prohibited.

  3. Company makes no warranties in relation to the Software, including warranties as to the performance or fitness for purpose of the Software. Software is distributed "as is". Absolutely no warranty of any kind is expressed or implied. You agree to use the software entirely at your own risk. Company will not be liable for any monetary losses, loss of data, damages, or any other kind of unforeseen losses occurring as a result of use of this software.

  4. You may not alter this software in any way.

  5. You may not reverse engineer, decompile, or disassemble the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

  6. License granted by clause 1 does not make you the owner of the Software nor does it cause any transfer or assignment of any copyright or any other intellectual or industrial property rights subsisting in the Software to You. Company reserves all rights not expressly granted to you in this EULA. The Software is protected by copyright and other intellectual property laws and treaties. Company owns the title, copyright, and other intellectual property rights in the Software. The Software is licensed, not sold.

  7. You understand and agree that in order to make our services functional, the Software uses Internet based services to communicate with our servers. The software does not monitor or report back to the company any information about your surfing behavior, or sites visited by you on the internet The Software communicates only in connection with providing our Services or in connection with data updates. You hereby consent to such communications. If you do not agree to this communication, please uninstall our Software. Further, you may not use any Internet-based services associated with the Software in any manner that could damage, disable, overload, harm, or impair such services or interfere with any other party's use of them. You may not attempt to gain unauthorized access to any service, account, computer systems or networks associated with the Internet-based services. Company reserves the right to discontinue Internet-based services provided to you or made available to you through the use of the Software at its discretion.

  8. Use of this software requires downloading and use of market information data ( Market Data ) from company's servers as well as third party sources, Company makes absolutely no warranties to the accuracy, timeliness, correct sequencing, or completeness, of the Market Data. You agree not to hold Company or its third party sources liable, in any way (including, but not limited to, any decision made or action taken in reliance upon the Market Data) for any inaccuracies in, errors in transmission delays, interruption in service of Market Data.

  9. You agree that installation of this Software permits the downloading to your computer software which allows us to update the Software for the purpose of fixing product defects or other functionality, or providing functional enhancements to the software, and that such updates may occur without notice to you. You agree to accept all such updates and agree that they are and shall be governed by this Agreement.

  10. This license commences when you install this Software and is granted in perpetuity, but may be terminated if you are in breach of any term of this license agreement.

  11. This license shall be governed by and construed according to the laws in force in Santa Clara County, California, USA.
